Summary One of the major achievements of the last 25 years has been the development of an Australian legal framework that makes sex discrimination in employment unlawful. Drawing on complaints lodged with the Victorian Equal Opportunity Commission, this paper explores the ways in which sex discrimination is manifested and understood in the workplace from the different perspectives of employee complainants and employer respondents. Despite these differences, the paper argues that both employee and employer understandings of 'discrimination' focus on the individual experience and practice of discrimination rather than the gendered employment and organisational contexts in which such understandings are negotiated. The paper concludes that the practical effect of anti-discrimination law is shaped as much by workplace norms and the broader social and political context in which the law is invoked as by the legislative provisions themselves.
